Applications for adoption of a child in South Sudan must be submitted to a court. Foreign prospective adoptive parents must submit their application to the High Court. Foreigners seeking to adopt must demonstrate that they: Have established residence in South Sudan for a minimum of three years; Have fostered the child for at least one year; The child will be adopted by a married U.S. citizen and spouse jointly or by an unmarried U.S. citizen at least 25 years of age, habitually resident in the United States, whom USCIS has found suitable and eligible to adopt (Form I-800A approval) with the intent of creating a legal parent-child relationship. To adopt a child from another country and bring that child to live in the United States, you must first be found eligible to adopt under U.S. law. The federal agency that makes this determination is U.S. Citizenship and Immigration Services (USCIS), part of the Department of Homeland Security. Run for many years by Sister Bianca Bii, Saint Bakhita Orphanage was built with the help of the Sudan Relief Fund and has been home to many children like it is today. Unfortunately, very recently the orphanage lost one of its major sources of funding. As a result, the home ran out of money and was unable even to buy food to feed the children.

Birth This section provides an overview of the intercountry adoption process. The process varies greatly, as it is governed by the laws of the countries where the adoptive parents and the child reside (which in the case of the United States means both federal and state law), and also in which of these locations the legal adoption is finalized. Sudan is facing extreme levels of food insecurity, with 17.7 million people —37% of the population—experiencing crisis (IPC 3) or worse levels. At crisis levels of food insecurity, families adopt negative coping strategies, like selling their possessions or marrying off their children, to secure enough food to meet their basic needs.
Now, conflict has worsened the economic crisis. Sudan's economy is projected to contract by 18.3 percent in 2023. Nearly half of Sudan's population is unemployed while the Sudanese pound has lost at least 50 percent of its value. In Khartoum, factories, banks, shops and markets have been looted or damaged, further reducing the population. Family and marriage are given an impossibly high importance in Sudanese culture, and adoption (of abandoned children) is almost an abomination of this norm. One particular saying goes: "صرخة جنى الحرام بتجيب الشيطان" Which means: 'the cry of a child born out of wedlock attracts the devil.'
